Not over yet for Uhuru, Muthaura

President Kibaki may have instructed the Attorney General to try and save his top allies from the jaws of International Criminal Court (ICC) and buy them time in office, but all that crumbled.

Even after yielding to public pressure and announcing Francis Muthaura had stepped aside, what opened a new friction point was the fact that Uhuru Kenyatta just let go the Treasury portfolio, but retained the Deputy Prime Minister post.

Though the DPM can only be removed by Parliament, or collapse of the Grand Coalition Government, the National Accord still sets out the option of him resigning. But last evening, the President, after meeting the two allies whose crimes against humanity charges ICC judges confirmed on Monday, seemed to suggest in his statement that the Constitution upholds Uhuru’s position as DPM. The same law took away his position as Finance minister after he was committed to full trial.

But the President, sources reveal, was left with little choice after the judges that committed four high profile Kenyans to full trial at The Hague, agreed with the Prosecutor that he did in fact attend a meeting with Mungiki at State House alongside Uhuru and Muthaura.

The President may have strenuously denied this and not for the first time on Wednesday, but it was quickly looking like he would not let them go because of the fact that he was bound by their case. The meetings, for which the two are in trouble, were reportedly convened to try and keep the President in office. But it seems the fire threatening to consume the careers of Muthaura, a retiree recalled to office by President Kibaki, and Uhuru who is fighting to take over his desk at State House in the General Election, was going up first, and getting too close to the President for comfort.

It is also believed the President yielded, believing that Uhuru’s forfeiture of the Treasury post and Muthaura’s exit would defuse rising tension in the coalition and pacify the Prime Minister, Raila Odinga.

The Prime Minister disowned the committee of experts set up by the Attorney General on Tuesday. But from the reactions that followed, the battle to get Uhuru out of Cabinet completely may just have started.

ODM is also now saying the decision to pick Francis Kimemia, who was the Internal Security PS to take over from Muthaura, is also unilateral and unacceptable because the PM was not consulted.

Stay became untenable

Although the civil society had persistently campaigned for their removal from office, their stay became untenable after ODM joined the fray.

The President is also believed to have released the two to deflect accusations that he was practicing double standards given that he suspended the other suspect, Eldoret North MP William Ruto, and released Henry Kosgey, who still has a pending court case.

There was also a precedent of ministers stepping aside, not even because they had court cases but to allow for investigations.

There were also reports that the President bit the bullet after it turned out the PM side of the Coalition had decided to boycott Cabinet so long us Uhuru and Muthaura, who has been its secretary, would be sitting in it. But this discomfort may not have been overcome: ODM is furious Kibaki let Uhuru retain the stronger of the two positions he held.

Lands minister James Orengo dismissed Uhuru’s exit only as Finance minister, and retaining DPM post, which allows him to sit in Cabinet, as a half-hearted measure.

Justice Minister Mutula Kilonzo noted that by retaining Uhuru as DPM, the President could have just accepted the resignation letter as Uhuru drafted it.

“Don’t blame the President; may be Uhuru drafted the resignation letter that way, but I can tell you that will not last for long,” he added.

Mutula said all Cabinet ministers, including the President, PM and his two deputies were State officers as outlined in Chapter 73 of the Constitution and, therefore, held those positions in public trust. “When you hold a State office you must be a person who brings honour to the nation and dignity to the office, as well as promoting public confidence in the integrity of office,” he added.

Orengo touched off fresh controversy saying the structure of the Coalition Government essentially meant acting Finance Minister Robinson Githae could technically report to the DPM. “To purport that Githae is the Finance minister who, in essence will report to Uhuru signifies a half-hearted change. Uhuru must go. There is no way you can purport to shower with your trousers on,” Orengo charged.

Special Programmes minister Esther Murugi who like Mutula is from the PNU wing asked: “Why are they so desperately baying for Uhuru’s blood?” She argued the ICC judges said despite their decision the accused should be presumed innocent and allowed to enjoy their liberties.

“The ICC judges were clear that their ruling does not interfere with the local affairs of those involved. So who are shouting the loudest?” she asked Murugi posed. “This whole thing is a political ploy,” she claimed.

Public Mood

The resignations, decided after President’s advisors gauged the public mood and felt it was steeped against Kibaki, were made public at Harambee House. The President, Muthaura, and Uhuru attended the meeting.

Sources within PM’s wing of the coalition told The Standard the party-allied Cabinet ministers had planned to boycott Cabinet meetings if Uhuru and Muthaura were to be retained.

“ODM ministers were not going to attend Cabinet meetings if Uhuru and Muthaura are in,” the source revealed.

Government Chief whip Jakoyo Midiwo, who is from the ODM wing, dismissed the move by the President to retain Uhuru as DPM and give his Treasury docket to Githae, saying the PM was not consulted. But the Treasury docket is PNU’s and the National Accord does not require the President to seek PM’s greenlight in who to appoint.

ODM’s beef appeared to be more about Kimemia’s appointment, and Uhuru’s retention as DPM.

“The President can appoint Kimemia as his secretary in his office, that’s okay but for the position of Head of the Civil Service, that he must consult the PM in accordance with the National Accord,” argued Midiwo.

Fire guts Kitgum stage in Lira

Businessmen and women from Kitgum district cried helplessly as their goods worth millions of shillings loaded in Kitgum bound trucks were being consumed in an inferno that gutted Kitgum stage in Lira on Thursday morning.

The fire that started at around 2:50am burnt down a police post, a make shift restaurant, two motor cycles and seven vehicles. Three of which were loaded with unspecified amount of merchandise belonging to Kitgum business people.

The vehicles include two FUSO Lorries registration numbers UAP 543F, UAB 149B, and a DYNA pick up number UAP 062L, a saloon car number UAF 173K, mini bus number UAF 858F and a Toyota Corona whose number could not be identified.

Also burnt was a government double cabin pick up registration UG 1756S that was travelling to Otuke district but the occupant decided to park it at the police post for safe custody for fear of travelling at night to Otuke since the road is very poor.

Paul Komakech a driver for the FUSO number UAP 543F said his vehicle was loaded with six grinding mills engines, 30 pieces of Iron sheets, 2 drums of petrol, 10 bags of cement, 7 bags of maize grains, 10 bags of rice, 5 bags of mukene fish and an assortment of merchandise.

“All these items and the lorry got burnt down and am confused not knowing what to do next,” he said.

Another driver identified as Christopher Ongun said his lorry was currying 50 bags of cement, 100 cartons of cooking oil, 40 school desk and construction materials for Akado primary school in Kitgum and a number of goods.

Lira District Police Commander, Robert Ssemata said while they could not rule out completely the work of arsonists, the information they got from residents was that an electric wire sparked and a lump of fire fell in the lorry currying two drums of petrol leading to the fire outbreak.

“It is very unfortunate because we tried all our level best to put off the fire using all means but failed since there is no firefighting equipment in this big town,” Ssemata said.

Lira RDC Susan Akany said she would request the president’s office to help procure firefighting equipment for the district so that such incidences could be contained in case it happens again.

Meanwhile shops and lock ups neighboring the scene of fire were all looted and left empty by those who disguised themselves as rescuers.

Subsidy strike: NLC accuses suspended Abia chairman of sabotage

UMUAHIA—THE national leadership of Nigeria Labour Congress, NLC, has suspended the chairman of Abia State chapter of the congress, Comrade Silvanus Eyeh, for alleged sabotage during the week-long strike declared by NLC to protest removal of oil subsidy by the Federal Government.

In his stead, Abia State chapter of the NLC yesterday elected Comrade C.C. Ebeniro, 1st Vice Chairman of the congress, to act as the chairman.

Eyeh was accused of not properly managing the NLC/TUC strike in the state and was accused of having worked against the strike.

Though Abia workers did not engage in any protest or rally during the strike, Eyeh’s trouble started on the third day of  the industrial action when Labour/TUC planned to hold a rally at School Road Primary School, Umuahia.

NLC/TUC members in response to radio announcement on the planned rally had gathered at the venue as directed and waited for hours for Eyeh and other leaders to arrive.

While they were waiting, words got to them that Eyeh and other leaders were called for a meeting at Government House by Governor Theodore Orji to appeal to them to cancel their planned rally/protest.

After the meeting, Eyeh emerged at the venue and announced to the disappointment and anger of the waiting workers that they should all go home and that the planned rally had been shelved.

The action infuriated the workers who attacked him and wanted to lynch him, but he escaped through the assistance of passers-by who hurriedly ferried him away.

The action of the suspended NLC chairman did not go down well with the headquarters of Labour which ordered his suspension.

Unlawful detention: IGP prays court to vacate compensation order

The Inspector General of Police, IGP, has urged an Ikeja High court to vacate an order directing him to pay N500,000 compensation for unlawful detention to Bishop  Kayode Williams, Director General, Prison Rehabilitation Mission International, PREMI.

The IGP’s request was contained in a motion by Mr. Abraham Fadipe, his counsel, who asked the court to lift the order on the ground that the court lacked the jurisdiction to entertain the case.

Williams had asked the court to award damages against the police for unlawful arrest and detention, where the court awarded N500,000 against the respondent.

Other respondents in the suit are the Lagos State Commissioner of Police and Mr Bashiru Kehinde.
When the matter came up, yesterday, the police IG also informed the court that its order was procured wrongfully, because the police was not put on notice.

The police, urging the court to vacate  the order for payment of compensation, contended that the applicant was under investigation in a case reported by the National Industrial Court, Lagos, following some exhibits found in his laptop.

ABUJA – CHAIRMAN, House Committee on Information and National Orientation, Omar Buba Jubril, has charged National Orientation Agency, NOA, to educate Nigerians on how to be vigilant in the wake of unrest created by Boko Haram in the country.

Jubril, who gave the charge when the committee visited the Director-General of the agency, Mr. Michael Omeri, on oversight function in Abuja, said people needed to know what to do in case of any suspicious movement around them.

The committee members, in a separate contribution, noted that the agency was diminishing in terms of efficiency, just as they challenged the new management to make use of their mega budget to earn the support of not only the lawmakers, but also Nigerians.

They said people could not feel the impact of the agency in the state and local levels, thereby preventing them from making meaningful inputs into government policy.

He said: “The reflection is what we witnessed in the last subsidy protest in the country. NOA as it is known in those days, longer exist. It is rather diminishing.

“I hope your administration will bring back the vibrancy. If you do not do your work, you don’t expect proper funding. But the little funds you have, make the best use of it.

“There must be a message. Find a way to drive it. The country has to be known with something. The impact of NOA is not felt at the state and local levels.”

Uwazuruike using MASSOB to exploit Igbos, Biafran group alleges

AWKA- ANOTHER  group agitating for the actualization of Biafra, the Biafra Zionist Movement, yesterday accused leader of the Movement for the Actualization of the Sovereign State of Biafra, MASSOB, Chief Ralph Uwazuruike, of exploiting Igbos and misleading them in the name of championing the struggle for the actualization of Biafra Republic.

Leader of the group, Mr. Benjamin Onwuka, who addressed newsmen with members of his group, said MASSOB had been cashing in on the ignorance of the people and using the struggle for the Biafra Republic to make money for themselves.

According to him, Uwazuruike knows that he is not going about the struggle the right way that would lead to the actualization of the new republic.

He  added that the right thing to do was to get the international community to support the struggle, which his group was doing.

He said:  “We must get the support of the United States of America to be able to undermine the United Kingdom who do not want us to be free, and as I talk to you now, the process is in place”.

There is no way you can split an oil producing nation without the knowledge of the USA, this is a country that buys more oil from Nigeria than we consume.

“We cannot divide this country without being in the foreign media and making the USA see reasons why they should support our secession bid”, he said.

But the Director of Information of MASSOB, Mr. Uchenna Madu, who reacted to Onwuka’s allegation, accused the group of being sponsored by government to cause confusion among the Igbo.

He said MASSOB remained the foremost organization working for the actualization of Biafra, adding, however, that his group would not stop any organization with genuine intentions for the support of the cause.

Madu said:  “MASSOB represents the most genuine interest of Ndigbo and has maintained consistency in the hands of the Nigerian government persecutions, torture, detention, imprisonment.

“Uwazuruike has paid a lot sacrifices for the sake of Ndigbo. He has no match. Agitations are not done on pages of newspapers. Ndigbo should ignore Onwuka and his group because they are looking for cheap popularity.”
