A 38 year old driver has been sentenced to seven years imprisonment by an Accra Circuit Court for attempting to have sexual intercourse with a five year old kindergarten pupil.
The accused person, Richard Amofa, took the victim together with her three year sister in his car, and sexually assaulted the victim after her younger sisters had slept.
He pleaded guilty to the charge of defilement of a child under 16 years old before the court presided over by Miss Sedina Agbemeva, and was convicted on his own plea to a jail sentence of seven years with hard labour.
Narrating the facts of the case, the prosecutor, Chief Inspector I.A.A Ahor, told the court that on March 26, 2012 at about 11:00 a.m., the victim went to a public toilet around the Nima Polyclinic area with her junior sister.
According to him, on their way back home, the accused person spotted them, bought them chewing gum, and lured them into his Nissan Urvan mini-bus.
“The accused person then attempted to have sexual intercourse with her by forcing his penis into her vagina, but could not penetrate her. The victim felt pains, but the accused person warned her not to disclose to anyone else she will die,” the prosecutor added.
He mentioned that on April 30, 2012, the complainant noticed that the victim was not walking well, and when she confronted her, she mentioned the accused person as the one who tried to penetrate her with his penis.
Chief inspector Ahor pointed out that a formal complaint was, therefore, lodged at the Nima police station and a police medical form was issued to the complainant to take victim to the hospital for examination, treatment, and report.
He said the accused person was later arrested, and the case transferred to the Domestic Violence Victim Support Unit (DOVVSU/AR), adding that the accused person admitted the offence in his caution statement.
