Appeal court sitting in the nation’s capital, Abuja on Wednesday reinstated the former governor of Osun State Prince Olagunsoye Oyinola as the National Secretary of the ruling Peoples Democratic Party (PDP).

Oyinlola was sacked from office by Justice Abdul Kafarati of a federal high court, Abuja. The trial court removed Oyinlola on the ground that the South-West congress of the party which produced him as nominee was in violation of two separate orders of a Lagos Federal High Court which nullified the Congress.

The Ogun State chapter of the party had through its chairman, Adebayo Dayo challenged Oyinlola?s nomination by the South-West zone of the party on ground that there were two orders which nullified the South-West zonal congress.

Not satisfied with the judgement of the High Court, Oyinlola, through his counsel, Professor Awa Kalu (SAN), lodged an appeal at the appeal court to challenge Justice Kafarati’s judgement.

In its judgement, the court said the trial court acted in error by granting the declarative reliefs sought by the Ogun State chapter of the PDP that challenged Oyinlola’s election in court, since Oyinlola was not a party to the suit that nullified the South-West congress of the party which produced Oyinlola.

The court said Oyinlola’s right to fair hearing was infringed upon.

The court therefore invoked Section 15 of the Court of Appeal Act and held that the lower court had infringed on the fundamental human rights of the appellant to fair hearing.
