A High Court sitting in Bida, Bida Local Government Area of Niger State has restrained a Magistrate and one Azatu Adamu, ex-wife of the octogenarian and superpolygamist, Mohammed Bello Masaba and 7 others from taking further legal action against them (applicants) pending the outcome of a case before it. 

Mansaba, an Islamic cleric and seven others are asking the High Court to set aside the decision of a Magistrate to refer a case of assault and criminal force filed by Azatu Adamu against them to the Niger State Attorney General and Commissioner for Justice for ?possible prosecution?. 

It would be recalled that Azatu Adamu had on August 15, 2013, complained before the Bida Magistrate court, accusing the applicants of criminal force and assault, causing grievous harm on her contrary to Section 265 and 246 of Penal Code Law. 

Sequel to the complaint, the court referred the case to the Police for investigations, when the applicants pleaded not guilty against the accusation.

On completion of investigation, the Office of the Area Commander, Nigeria Police, Bida, submitted a report of no evidence established or found against Masaba and 7 others on any of the allegations. 

However, the applicants were surprised to hear on February 27, 2014, that the presiding Magistrate, Rahamat Adamu Gado, had directed that the case file be referred to the office of the Attorney General and Commissioner for Justice for possible prosecution or action.
