A former Upper East Regional administrator of the Ghana Water Company Limited (GCWL) has sued the company over
his premature retirement. The plaintiff, Joseph Kojo Kankam, has hauled the company before an Accra high court after his contract with the company was abruptly abrogated in July 31, 2012 due to a glaucoma disease that has
blinded him.

The plaintiff wants payment of all his entitlements and other things commiserate with the position of a regional administrative officer from July 2013.

According to 1st Law Legal Practitioners/Consultants, lawyers for Mr. Kankam (plaintiff), headed by Vincent Aikins, say their client must be paid interest on all monies due him at the current commercial bank rate from July 2013 to the date of final payment.

The plaintiff is seeking re-instatement as Senior Human Resource Officer forthwith and damages for breach of contact.

In his statement of claim, Mr. Kankam narrated his working history with the GCWL since 1992, through to several positions he had held until the termination of his appointment. He said he was transferred from the Upper East to the Accra head office because of his medical condition to enable him have easy access to the eye clinic.

The plaintiff stated that a month after his transfer he was enrolled at the Ghana Federation of the Blind to learn new skills in computer technology for the blind to enhance his working skills. He said while in school, he was informed that after the course, he would require a software installed in his computer to assist him.

Mr. Kankam stated among other things, that his contract was abrogated based on a medical report not issued by a medical board, contrary to Article 6.13 of the Collective Bargaining Agreement (GBA) for Senior Staff.

As a result, lawyers for the plaintiff further averred that the whole process and procedure schemed by the defendant to ?ensure his exist from the company were tainted with fraud and acrimony.? Mr. Kankam wants the court to declare that his premature retirement was unlawful.
