jailed

Kwame Nuhu, a fisherman who sodomised a 14-year old Junior High School pupil, was yesterday sentenced to eight years in prison by an Accra Circuit Court.

The accused person who initially denied that he ever called the minor to his room, later told the court, presided over by Ms Sedina Agbemava, that he had changed his mind and wanted to change his plea.

Nuhu was additionally charged with escaping from lawful custody and pleaded guilty to defiling a minor saying that he was the one who defiled the victim.

However, on the charge of escaping from lawful custody, he said it was the first time he had been arrested and put before bars so he was afraid of what might happen to him there.

The trial judge consequently handed down an eight-year sentence to the fisherman and noted that she did not find his reason for escaping from lawful custody tenable.

According to her, under no circumstances should he have escaped from lawful custody and sentenced him to nine months imprisonment for the escape. Both sentences would run concurrently.

The facts of the case as presented by the prosecutor, ASP J.K. Anim, are that the complainant is the mother of the 14 year- old pupil who is in Junior Secondary School.

He said on June 6, 2012 at about 8pm, the victim went to a place of convenience which was a few meters from their house. While on his way, the Kwame Nuhu called the boy under the pretext of having  a word with him.

The police officer noted that the victim consequently went to Kwame Nuhu and the latter managed to lure the boy into his room . When the victim entered, Nuhu locked the door, took off victim?s pant and had sex with him through his anus.

Furthermore, the police officer said the accused person afterwards gave the victim GH?16 and told him to go home but warned him not to disclose what happened between them to anybody.

In addition, he stated that when the victim got home, he started feeling pains in his anus and not being able to withstand it anymore informed his mother about his ordeal.

Explaining further, he said the complainant went and lodged a complaint with the police who issued a form for him to attend the hospital for medical treatment.

He said the accused person was consequently arrested and he admitted the offence. But while in police custody, he  attempted to escape but was chased.

J.K. Anim said Nuhu was consequently arrested and arraigned after police concluded investigations.
